Please attend the hearing on Egan Slough Community and Yes! For Flathead Farms and Water et al. vs. Flathead County Board of County Commissioners and Montana Artesian Water Company et al.the lawsuit seeking to enforce the Egan Slough zoning regulations, which will be heard in Flathead District Court, 920 South Main Street – third floor, Judge Allison’s courtroom on NOVEMBER 12, 2019 at 9:00 a.m.

 

Our attorneys’ will be presenting Summary Judgment arguments and asking the Judge to make a final ruling declaring that Flathead County must enforce the Egan Slough Zoning regulations, and to find that the Montana Artesian water operation is not a legal pre-existing nonconforming use under those regulations.  They will be arguing that Flathead County Commissioners’ decision to allow Montana Artesian Water Company to begin operating after Initiative 17-01 was passed by 70% of Flathead County voters was unlawful and an abuse of discretion.   Please join us in blue Tuesday November 12 at 9:00 a.m. in Judge Allison’s Court, 920 South Main Street – third floor.
