17 May CALL TO ACTION – PLEASE ATTEND MAY 21 HEARING
CALL TO ACTION – PLEASE ATTEND HEARING AND SHOW SUPPORT FOR THE EGAN SLOUGH INITIATIVE 17-01 – This Tuesday, May 21 at 9:00 a.m at Flathead District Court, 920 South Main St. Kalispell on third floor, please attend the presentation of oral arguments in Judge Allison’s Court to show your support for Initiative 17-01 that was passed by 70% of Flathead County voters last June 5. As you may know, Yes! For Flathead Farms and Water has an active lawsuit against the County for deciding in January that the bottling plant is a grandfathered nonconforming use. Montana Artesian Water Company has countered our lawsuit by challenging the legality of the initiative. The hearing on Tuesday May 21 is scheduled for 1 hour during which the District Court will hear arguments on technical legal issues on the validity of the initiative. We are confident in our position that the entire county does have the right to vote on a zoning issue that protects our water, river, fish and farms which are beneficial to every citizen in Flathead County. Once again, we are disappointed in our county commissioners, who have chosen not to defend the initiative against this legal attack by the Montana Artesian Water Company that threatens our water, wells and lakes.
Please sit on our side of the court, wear blue and thank you so much for your continued support! Our attorneys have reminded us to be quiet and respectful in the court room at all times.
